Competition rules for “Win an extra month’s pay”

The company Accent Construct NV, with its registered office at Beversesteenweg 576, 8800 Roeselare and company number 0887.120.626 (hereinafter: “Accent Construct”), is organising a competition entitled “Win an extra month’s pay” (hereinafter: “the Competition”). The Competition will run from 8.30am on 17 July 2023 until 5.30pm on 15 September 2023 (hereinafter: “the Duration”). 

The Competition is a contest in which participants (hereinafter: “the Participants”) can take part by answering the following competition question (hereinafter: “the Competition Question”): 

“How many participants will this competition have by 31 August 2023?” (tip: a similar Accent campaign in 2019 had 354 participants after 6 weeks). 

The Participants can win an extra month’s pay (hereinafter: “the Prize”), which will be calculated and awarded as specified in these Competition Rules. There will be one winner as this prize will be awarded once. On 30 October 2023, an Accent Construct employee will announce the winner via a personalised email. 

The Competition can be accessed via the following page: www.accentjobs.be/wineenextramaandloon (hereinafter: “the Competition Page”). 

The winner is eligible only for the Prize described above. 

 

 

SECTION 1 – WHO CAN PARTICIPATE? 

1.1. Natural persons (i) who are at least 18 years old at the time of participation, (ii) who have a valid email address, (iii) who have an official residence in Belgium during the Duration of the Competition, (iv) who register in their own name and (v) who satisfy the competition terms* can participate in the Competition. Accent Construct cannot be held liable for the participation of minors in the Competition and expressly reserves the right to disqualify minor participants.


*The competition terms are as follows: the Participant (i) has signed a registration form with Accent Construct, (ii) has effectively worked via Accent Construct for at least 30 days during the Duration of the Competition, (iii) is bound by an employment contract for temporary agency work with Accent Construct at the time of the award of the Prize (i.e. on 30 October 2023), (iv) is a new candidate, (v) is not employed as a work-placement student or flexi-job worker and is a candidate selected by Accent Construct itself (not a payroll candidate via an Accent Construct client). New candidate is understood to mean someone who has not yet entered into an employment contract for temporary agency work with Accent Construct in the year 2023 (hereinafter: “the Competition Terms”). 

1.2. Each Participant can only take part once and has only one chance to win the Prize. 

1.3. The following are not permitted to take part in the Competition: (i) persons who work in-house at Accent Construct, its branches, its partners or their branches or with any other company that is involved in the organisation or dissemination of the Competition and (ii) persons who have a direct relationship with the above-mentioned persons (blood relatives in the ascending or descending line, spouses, brothers and sisters). 

1.4. Any infringement of the above-mentioned rules will lead to the immediate and automatic disqualification of the Participant without prior notice. 

 

SECTION 2 – COMPETITION

2.1. The Competition is offered to the Participants at no charge and no purchase is required for participation. 

2.2. The Competition will run from 17 July 2023 until 5.30pm on 15 September 2023 and will consist of one round after which the winner will be selected based on the Competition Terms and the answer to the Competition Question. 

On 30 October 2023, an Accent Construct employee will announce the winner via a personalised email. The Competition is a competition in which participants can win one extra month’s pay, which will be calculated and awarded as specified in Section 5 of these Competition Rules. The Competition can be accessed via the Competition Page. 

The winner is eligible only for the Prize described above. 

2.3. Accent Construct reserves the right to extend the Competition without prior notice. If Accent Construct decides to run the Competition for longer, information about this will be posted to the Competition page. 

Accent Construct also expressly reserves the right to terminate the Competition earlier than specified in these Competition Rules at any time at its own discretion. 

 

SECTION 3 – HOW CAN YOU PARTICIPATE? 

3.1. The official competition page can be found on the Competition Page. 

3.2. During the Duration, Participants can participate in the Competition by: 

  • Visiting the Competition Page;
  • Completing the form on the Competition Page and thereby registering for and entering the Competition; 
  • Answering the Competition Question; 
  • Complying with the Competition Terms; 
  • Accepting the Competition Rules; 
  • Having read and understood the Privacy Policy; 

3.3. By entering and answering the Competition Question and complying with the Competition Terms, each Participant will have one chance to win the Prize when the Competition ends. 

3.4. All answers uploaded by Participants must comply with the applicable legislation and the prevailing standard of decency. Accent Construct reserves the right at all times to remove material from the Competition Page as it sees fit if it considers there is reason to do so. Accent Construct is not required to inform the Participant in question of any such removal and will under no circumstances be obliged to pay compensation. 

3.5. There can be no participation in the Competition through correspondence or in any other form except via the Competition Page provided by Accent Construct for the purpose. 

 

SECTION 4 – SELECTION OF THE WINNER

4.1. At the end of the Competition, the Participant whose answer is closest to the correct answer to the Competition Question and who complies with the Competition Terms (hereinafter: “the Winner”) will win. In case of a tie, the time of entry will be taken into account, and the Participant who answered first will win. The Winner of the Prize will be determined and announced by the Jury at the end of the Competition. 

4.2. Within 7 days of selection, the Winner will be notified personally, by email or telephone. When the Winner receives notice, they should contact Accent Construct. 

The Participants who do not win the Prize will not receive any written notification or other type of notice to inform them that they did not win the Prize. 

4.3. The identity of the Winner may be published on the Competition Page as soon as they are known. The Winner will be contacted personally. 

 

SECTION 5 – PRIZES

5.1. The Prize covers one extra month’s pay, which includes: 

  • the gross hourly wage in accordance with the first payslip of the employment through Accent Construct during the Duration of the Competition (hereinafter: “the Payslip”); 
  • multiplied by a factor of 4.3333; 
  • multiplied by the number of hours actually worked in accordance with the Payslip (excluding overtime); 
  • reduced by tax and social security contributions. 

Anything not included in the above list will not be counted for the calculation of the Prize. 

The Prize will be deposited into the Winner’s account (as specified on the registration form). 

5.2. The Prize cannot be returned or exchanged, it cannot be exchanged for money or foreign currency, and it cannot be transferred to someone else. 

 

SECTION 6 – DISQUALIFICATION, SUSPENSION OR CANCELLATION

6.1. Any violation of these Competition Rules or any fraud will result in the disqualification of the Participant. Accent Construct may disqualify a Participant if it has reason to believe that these Competition Rules have been violated. 

6.2. Participants who are disqualified can no longer participate in the Competition. Accent Construct’s decisions in this regard are final and cannot be appealed. 

6.3. Accent Construct reserves the right to shorten, suspend, change or cancel the Competition in the event of circumstances beyond its control or in the event of force majeure, as a result of which it is no longer possible to proceed with the Competition in accordance with the present Competition Rules, for example in the event of Internet issues or any other problem related to telecommunication networks, computers or servers, Internet providers, information systems or computer programs. 

6.4. Furthermore, Accent Construct reserves the right to shorten, suspend or extend the Competition at its own discretion and as it sees fit. 

6.5. In the event of a change or suspension on the basis of Sections 6.3 or 6.4, Accent Construct will announce this change or suspension clearly on the Competition Page. 

6.6. If the Competition Rules are changed by Accent Construct, the Participants will receive a notification of this change. In that case, they will have a choice between participating and withdrawing from the Competition. 

 

SECTION 7 – LIABILITY

7.1. Any disputes or complaints related to the Competition must be addressed exclusively to Accent Construct. 

7.2. To the maximum extent permitted by applicable law, Accent Construct is only liable for direct damage proven by the Participant that is the direct result of a failure by Accent Construct or its agents to fulfil the essential obligations that are the subject of these Competition Rules, of intent or of inexcusable gross negligence by Accent Construct or its agents. 

Moreover, Accent Construct’s total liability for all damages suffered by a Participant is hereby limited to an amount of EUR 1,000.00. 

7.3. Accent Construct is not liable for indirect damage that occurs in the context of participation in the Competition, of whatever nature and regardless of the cause, origin or consequences, even if it was warned about the risk of this damage, including damage resulting from:

  • disruptions or problems with the Internet or the computer of a Participant or any other problem related to the telecommunication networks, computers or servers, Internet providers, information systems or computer programs;
  • anyone’s access to the Competition Page or the inability to obtain access to the Competition Page;
  • the use of the Competition Page, including any malfunction or virus that might infect and/or damage the IT equipment or other goods of the Participant. 

7.4. If the Competition is terminated because of the conduct of one of the Participants, Accent Construct reserves the right to claim compensation for the resulting loss. 

7.6. Except in cases of gross or intentional negligence, neither Accent Construct nor its employees, nor any third party engaged for the organisation of the Competition, can be held liable for any damage of whatever nature that might result from the participation in or organisation of the Competition, the selection of the Winner and whether or not the Prize is awarded. The liability of the parties specified in this paragraph cannot be increased in any way as a result of changes in the Competition or suspension or termination of the Competition. 

7.7. The Participants are personally responsible for the content of the answers they upload on the Competition Page. The Participants guarantee that the answers submitted do not infringe on the rights of third parties and they will fully indemnify and safeguard Accent Construct against any third-party claims against Accent Construct. 

7.8. Accent Construct cannot be held liable in any way for the content of the Competition Page and the answers submitted or for their illegitimate use. 

 

SECTION 8 – ACCEPTANCE

Participation in the Competition implies full knowledge and irrevocable acceptance without reservations of the present Competition Rules. By participating in the Competition, Participants accept all the provisions of the Competition Rules as well as any decisions made by Accent Construct. 

 

SECTION 9 – PRIVACY

9.1. During and after the Competition, the Participant communicates personal data to Accent Construct. 

Accent Construct processes such personal data in accordance with the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, transposing, supplementing and implementing European Regulation 2016/679 of 27 April 2016 on the protection of personal data (hereinafter: the “GDPR”) and the Act of 13 June 2005 on electronic communications. 

Accent Construct processes the Participant’s personal data with due care and confidentiality, in accordance with its Privacy Policy (available on the website www.accentjobs.be). The Participant declares that they have read and understood the Privacy Policy. 

 

9.2. The controller for processing the personal data of the Participants is Accent Construct NV, Beversesteenweg 576, 8800 Roeselare. 

9.3. The personal data referred to include the surname, first name, company name, email address, telephone number and postal code of the Participant. The personal data are collected with the aim of conducting the Competition properly, in particular so that the Participants can be contacted concerning their participation, the Prize can be handed out in an efficient manner and the name and winning answer of the Winner can be published on Accent’s Website and Facebook or Instagram page, and also so that the Participants can be assisted in their search for a suitable job. 

9.4. The Participants guarantee that they will supply Accent Construct with personal data in a lawful manner, and they will therefore fully indemnify and safeguard Accent Construct against any third-party claims against Accent Construct due to unlawful processing of their personal data. 

9.5. All Participants have certain rights related to the processing of their personal data: 

  • Right of access and inspection: Participants have the right at any time to inspect their personal data free of charge and to be told how Accent Construct uses said personal data. 
  • Right to rectification, erasure and restriction: Participants have the right to decide whether or not to share their personal data with Accent Construct. In addition, Participants always have the right to ask Accent Construct to rectify, supplement or erase their personal data (in the cases provided for by the GDPR). Participants acknowledge that, if they refuse to supply personal data or ask to have personal data erased, certain services and products cannot be provided. Participants may also ask to restrict the processing of their Personal Data. The participation of Participants who ask to have some or all of their data erased before the end of the Competition, such that Accent Construct is no longer able to contact these Participants, will be declared invalid and these Participants will not be eligible for the Prize. 
  • Right to object: Participants also have a right to object to the processing of their personal data for serious and legitimate reasons (in the cases provided for in the GDPR). In addition, Participants always have the right to object to the use of personal data for purposes of direct marketing; in that case no reason needs to be provided. 
  • Right to free data portability: Participants have the right to obtain their Personal Data that are processed by Accent Construct in a structured, commonly used and machine-readable form and/or to transfer them to other controllers (in the cases provided for in the GDPR). 
  • Right to withdraw consent: Insofar as the processing is based on prior consent, Participants have the right to withdraw this consent. The participation of Participants who withdraw their consent before the end of the Competition will be declared invalid and these Participants will not be eligible for the Prize. 

These rights can be exercised by contacting Accent Construct to this end by post, by sending a letter with a copy of a form of identification to: Accent Construct NV, Beversesteenweg 576, 8800 Roeselare. 

 

SECTION 10 – DISPUTES

10.1. Disputes or complaints regarding this Competition must be mailed within 8 days to: Accent Construct NV, Beversesteenweg 576, 8800 Roeselare. 

10.2. In the event of disagreement about the application or interpretation of these Competition Rules, the Participants undertake to try to find an amicable solution in consultation with Accent Construct first before initiating legal proceedings. 

10.3. The selection of a winner is not subject to dispute. 

10.4. All decisions made by Accent Construct in the context of this Competition are final, irrevocable and binding. These decisions cannot be appealed. 

10.5. If one of the provisions of these Competition Rules were to be declared void or invalid, the other provisions of these Competition Rules will still apply in full. 

10.6. The present Competition Rules and the course of the Competition itself are subject to Belgian law. 

10.7. The appellate and district courts of Kortrijk have exclusive jurisdiction to hear disputes regarding the establishment, validity, implementation, fulfilment and interpretation of the present Competition Rules.
